This Privacy Policy (the "Policy") describes how Marketsniffr processes personal data in the context of the use of the Marketsniffr platform, the website www.marketsniffr.com and all associated applications and services (together the "Platform").

This Policy aims to transparently inform you about which personal data is processed, for what purposes and on what legal basis, how long this data is retained, with whom it may be shared, and what rights you have under applicable data protection legislation, in particular the General Data Protection Regulation ("GDPR").

No formal Data Protection Officer (DPO) has been appointed, as this is not legally required given the nature and scale of processing within Marketsniffr.

3. What personal data do we process?

Depending on your interaction with the Platform, the following categories of personal data may be processed:

Data identifying you as a user, such as name, professional email address, login and account data, user roles and organisation information. Contact and communication data that you voluntarily provide to us via email, forms or support channels. Billing and administrative data, including billing address, VAT number, invoice history and payment status. Technical and usage data, such as IP address, device and browser information, log files, usage statistics and security data. Data contained in projects, dashboards or analyses that you create within the Platform, insofar as these contain personal data.

Marketsniffr does not process special categories of personal data (such as health data) and does not expect such data to be entered via the Platform.

4. Origin of personal data

Personal data is obtained:

directly from you upon registration, use of the Platform or communication with us;

automatically through the use of the Platform and the Website;

from service providers who support us in hosting, infrastructure, analytics and payments.

In addition, Marketsniffr may process company information from public sources or external data sources. Information about legal entities does not fall under the GDPR; professional data of natural persons is processed exclusively within the limits of this Policy.

5. Purposes and legal basis of processing

Personal data is processed exclusively for specific and legitimate purposes, on the basis of one or more of the following legal grounds: performance of a contract, compliance with a legal obligation, legitimate interest or your consent.

More specifically, we process personal data for: the creation and management of user accounts and access to the Platform; the provision, maintenance and improvement of services; support, communication and customer service; billing, payments and accounting obligations; security, fraud prevention and abuse detection; anonymised statistical analysis and optimisation of the Platform and its algorithms; marketing and commercial communication, within the legal limits.

Anonymised and non-traceable data may be used for analysis, statistics and platform improvement. This data cannot be linked back to a natural person or individual company.

6. Transfer to third parties

Personal data may be shared with: service providers (processors) such as hosting providers, IT infrastructure, analytics and payment services (including Stripe); professional advisers (accounting, legal, audit); competent public authorities where legally required; parties involved in a possible restructuring, merger or acquisition.

All processors act exclusively on instruction from Marketsniffr and under appropriate contractual safeguards.

7. International transfers

Personal data may be processed outside the European Economic Area if this is necessary for service provision by external partners. In that case, appropriate safeguards are provided in accordance with the GDPR, such as standard contractual clauses.

8. Retention periods

Personal data is not retained longer than necessary for the purposes for which it is processed, taking into account statutory retention periods and legitimate business needs.

Account and platform data is in principle retained for as long as the account or subscription is active. After termination, data may be retained temporarily for administrative handling, dispute management and security, after which it will be deleted or anonymised.

The timely export and retention of data you wish to keep remains your own responsibility, as set out in the Terms and Conditions.

9. Your rights

You have the rights provided by the GDPR, including the right of access, rectification, erasure, restriction of processing, data portability and objection. Where processing is based on consent, that consent may be withdrawn at any time.

You can exercise your rights by contacting us at privacy@marketsniffr.com. We may request identity verification to prevent misuse.

10. Complaints

If you believe that your personal data is being processed unlawfully, you may lodge a complaint with the competent supervisory authority. In Belgium, this is the Data Protection Authority (Gegevensbeschermingsautoriteit).

11. Security

Marketsniffr takes appropriate technical and organisational measures to protect personal data against loss, unauthorised access or misuse. Absolute security cannot, however, be guaranteed.

12. Changes

This Privacy Policy may be updated in response to legal, technical or commercial developments. The most recent version is always available on the Platform.
